Employer / Customer Terms of Use

These Employer Terms of Use (“Terms”) govern your use of the services, websites, and applications offered by FloCareer Inc. (“FloCareer,” “we,” “us,” or “our”) when you or your organization (“Customer”) access the FloCareer Platform to recruit, evaluate, or otherwise engage with Candidates and FloExperts. By accessing or using the Platform, you agree to these Terms and to our Privacy Policy and Cookie Policy.

Account & Access

• You must provide accurate information when creating and managing Customer accounts.
• You are responsible for activity under your account, including actions by authorized personnel.
• You must ensure that access credentials are safeguarded.

Authorized Use

You may use the Platform solely to evaluate and recruit candidates and manage interviews. You may not:

• Resell or sublicense Platform access.
• Misuse Candidate or FloExpert data outside the scope of hiring evaluation.
• Use the Platform in any way that is unlawful or infringes third-party rights.

Candidate Data & Privacy

• You may access Candidate resumes, Interview Results, and related information solely for hiring evaluation.
• You must handle Candidate personal data in compliance with applicable privacy laws.
• You may not repurpose, resell, or share Candidate data outside your hiring processes.

FloExpert Data & Confidentiality

• You may access Interview reports and anonymized interviewer profiles.
• You may not disclose, resell, or reuse FloExpert identities or personal details beyond authorized hiring activity.
• All interview recordings and reports are FloCareer property and licensed to you for evaluation purposes only.

Fees & Payments

• If your organization subscribes to paid services, you agree to pay fees as specified in your order form or agreement.
• Fees are non-refundable except as required by law or contract.
• FloCareer may suspend or terminate access for non-payment.

Intellectual Property

• FloCareer retains all rights in the Platform, Interview Content, reports, and analytics.
• You may use outputs (reports, results) solely for internal hiring purposes.
• You may not copy, resell, or republish Interview Content or Candidate materials.

Confidentiality

You may receive confidential information about Candidates, FloExperts, or FloCareer. You agree to:

• Use such information only for evaluation and hiring.
• Maintain confidentiality and restrict access within your organization.
• Delete or return confidential information upon request or termination.

Compliance Obligations

• You represent that you will comply with applicable labor, anti-discrimination, data protection, and employment laws when using the Platform.
• You may not use the Platform to discriminate against Candidates based on protected characteristics.

Disclaimer of Warranties

The Platform is provided “as is” and “as available.”FloCareer disclaims all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law:

• FloCareer shall not be liable for indirect, incidental, special, or consequential damages (e.g., lost profits, lost data, goodwill).
• Aggregate liability is capped at fees paid in the 12 months preceding the claim or USD $100, whichever is lower.

Indemnity

You agree to indemnify and hold harmless FloCareer against claims, damages, or expenses arising from your misuse of Candidate or FloExpert data, violation of law, or breach of these Terms.

Termination

FloCareer may suspend or terminate your access if you violate these Terms or fail to pay fees. Upon termination, you must cease using the Platform and delete all Candidate and FloExpert data obtained from it.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes, controversies, or claims arising out of or in connection with these Terms, including disputes regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

At FloCareer’s discretion, disputes may alternatively be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended), with proceedings conducted in English and seated in Bengaluru, India.

Miscellaneous

• Failure to enforce is not a waiver.
• If any provision is invalid, the rest remain enforceable.
• Certain provisions (confidentiality, data handling, disclaimers, limitations, indemnity) survive termination.
• FloCareer may update these Terms; continued use constitutes acceptance of the revised Terms.

Candidate Terms of Use

These Candidate Terms of Use (“Terms”) apply to individuals who participate in assessments, and interviews (“Interviews”) through FloCareer Inc. (“FloCareer,” “we,” “us,” or “our”) and who access or use the FloCareer website, interview platform, services, and Interview Content (as defined below) (collectively, the “FloCareer Platform”).

By using the Platform, you agree to these Terms and to our Privacy Policy and Cookie Policy.

Right to Use

Subject to your compliance with these Terms, FloCareer grants you a non-exclusive, non-transferable, non-sublicensable, revocable, limited right to access and use the Platform for personal use.FloCareer reserves all rights not expressly granted. No sale or license of software or intellectual property is made by these Terms.

Platform Access

• FloCareer may provide you secure, custom links to access the Platform.
• You must keep such access credentials secure and notify us immediately if you suspect compromise.

Restrictions

You agree not to use the Platform in ways that:

• Are harmful, fraudulent, harassing, defamatory, obscene, or otherwise unlawful.
• Attempt to obtain passwords, accounts, or security information from others.
• Run spam, auto-responders, or processes that overload the Platform.
• Compete directly with FloCareer using the Platform.
• Crawl, scrape, spider, decompile, reverse engineer, or attempt to access source code.
• Violate any law or regulation.

Interview Conduct

• You agree to keep all information, questions, answers, and materials provided, created, or discussed during an Interview (the “Interview Content”) strictly confidential.
• You will not copy, record, screenshot, or remove Interview Content unless expressly permitted.
• Your responses must be your original work without unauthorized assistance.
• You may not improperly disclose third-party confidential information (e.g., from a current or former employer).
• If you have previously encountered the Interview Content, you must notify FloCareer.

Privacy

By using the Platform, you acknowledge and consent to the collection, use, and sharing of your personal information as described in our Privacy Policy.

Interview Results

You consent to FloCareer:

• Recording your answers, audio, video, and platform interactions during Interviews.
• Sharing Interview recordings, answers, scores, and results (collectively, “Interview Results”) with prospective employers, consistent with the Privacy Policy.
• Using Interview Results internally to improve and develop products and services.

FloCareer owns all rights, title, and interest in Interview Content, Interview Results, and derivatives, including copyright. You hereby assign to FloCareer any rights you may have in Interview Results.

We may deidentify or anonymize your information such that it cannot reasonably be used to infer information about you or otherwise be linked to you (“deidentified information”) (or we may collect information that has already been deidentified/anonymized), and we may use deidentified information for any purpose. To the extent we possess or process any deidentified information, we will maintain and use such information in deidentified form and not attempt to re-identify the information, except for the purpose of determining whether our deidentification process satisfies legal requirements.

Violations and Remedies

Failure to comply with these Terms may result in immediate, temporary, or permanent withdrawal of your right to use the Platform.

FloCareer may also report violations to prospective employers. We are not responsible for employer decisions in response to such reports.

Waivers and Release

• FloCareer makes no guarantee that any Interview or feedback will result in an employment offer or benefit.
• FloCareer is not responsible for the actions of employers or third parties who receive Interview Results with your consent.
• You waive and release FloCareer from any claims or liability arising from your participation in Interviews or employer use of Interview Results.

Warranty Disclaimer

The Platform is provided “as is” and “as available.”FloCareer and its affiliates disclaim all express or implied warranties, including merchantability, fitness for a purpose, and non-infringement.We do not warrant uninterrupted or error-free operation.

Limitation of Liability

To the fullest extent permitted by law:

• FloCareer shall not be liable for indirect, incidental, special, consequential, or punitive damages (e.g., lost profits, lost data, goodwill, or computer malfunction).
• Aggregate liability is capped at USD $100.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes, controversies, or claims arising out of or in connection with these Terms, including disputes regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

• You must be at least 18 years of age to use the Platform.
• Failure by FloCareer to enforce any provision is not a waiver.
• If a provision is unenforceable, the remainder stays valid.
• FloCareer has no control over third-party websites or services you may access through the Platform. You release FloCareer from liability relating to such use.
• FloCareer may revise these Terms from time to time. Continued use after changes constitutes acceptance of the revised Terms.

FloExpert (Interviewer) Terms of Service

These FloExpert Terms of Service (“Terms”) govern your access to and use of the services, websites, and applications offered by FloCareer Inc. (“FloCareer,” “we,” “us,” or “our”). By accessing or using the FloCareer Platform as a freelance interviewer (“FloExpert”), you agree to these Terms and to our Privacy Policy and Cookie Policy.

Eligibility & Accounts

• You provided consent for the email sent to your personal email by our internal team.
• You must provide accurate information (including your real name) when creating or updating your profile.
• You are responsible for safeguarding your password and activities under your account. We encourage the use of strong passwords. FloCareer is not liable for losses from your failure to secure your account.
• You represent that you are at least 18 years old.

Professional Conduct & Interview Etiquette

• Introduce yourself and your role clearly to the candidate.
• Maintain professionalism and treat candidates respectfully.
• Avoid discriminatory, biased, or irrelevant questions.
• Provide feedback that is constructive and role-related.
• Refrain from sharing personal opinions outside the technical discussion.

Non-Discrimination

You must avoid all forms of discrimination, including on the basis of gender, race, ethnicity, religion, age, disability, or any other protected category.

Confidentiality & Non-Disclosure

As a FloExpert you may access confidential material (candidate resumes, company profiles, job descriptions, skill matrices, question pools, previous reports, and candidate audio/video). You must:

Confidentiality & Non-Disclosure

As an interviewer, you may access confidential information such as candidate resumes, company profiles, job descriptions, skill matrices, question pools, reports, and candidate audio/video. You agree to:

• Use such information only for conducting the assigned interview.
• Not share, disclose, or distribute any confidential information.
• Not retain or store confidential information beyond completion of the interview. Notes must be deleted after submission of the interview report.
• Take reasonable steps to prevent unauthorized access (e.g., securing your devices).
• Never record, share, or reuse candidate video/audio outside the FloCareer Platform.

Breach of confidentiality may result in account termination, legal action, and other remedies.

Candidate Evaluation

• Evaluate candidates solely on job-relevant skills, knowledge, and performance.
• Ensure fairness, objectivity, and transparency.
• Clearly explain the interview’s purpose, skills assessed, and evaluation criteria at the beginning.

User Content

“Content” means any information, text, graphics, or materials (e.g., your resume, interview notes) you provide. You retain ownership of your Content.

By submitting Content, you grant FloCareer a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, reproduce, adapt, publish, transmit, and distribute such Content for service delivery and quality assurance.

You represent and warrant that your Content:

• Does not infringe copyright, trademarks, or third-party rights.
• Does not disclose trade secrets without permission.
• Does not include viruses, malware, or harmful code.
• Does not impersonate others or misrepresent affiliations

FloCareer may remove any Content that violates these Terms.

Exclusive FloCareer Content

You may not copy or reuse:

• FloCareer interview questions or answers.
• Contact information of Interviewers, Candidates, or Employers.

Rules of Use

You must not:

• Use the Platform for unlawful or fraudulent purposes.
• Spam or misuse communication features.
• Access non-public areas, probe vulnerabilities, or breach security.
• Use bots, scrapers, or automated means without permission.
• Forge headers or send deceptive communications.
• Interfere with Platform availability (e.g., viruses, flooding, scripting).
• Ignore or bypass configuration options for email notifications.

Proprietary Rights

All rights in the FloCareer Platform (excluding Content provided by users) remain the exclusive property of FloCareer and its licensors.The Platform may display advertising. By using the Platform, you consent to FloCareer and partners placing such advertising.

FloCareer respects intellectual property rights. If you believe your copyright has been infringed, contact gdpr@flocareer.com with required details.

Third-Party Links

The Platform may contain links to third-party sites or resources. FloCareer is not responsible for their content, accuracy, or availability. Use at your own risk.
